Who we are and these terms
These terms govern your use of tracklist.lol, a music discovery and chart service operated by Bearsoft Group Ltd (company number 14774267), whose registered office is 20 Pinnacle House, 4 Schooner Road, London, E16 2RE, UK. Questions about an order or these terms should be sent to mark@bearsoft.com.
By using the site, submitting a release or placing an order, you agree to these terms. If you are submitting on behalf of an artist, label or other organisation, you confirm that you have authority to do so.
The Tracklist service
Browsing charts, discovering releases, playing previews, liking songs and following links to independent streaming services are free for listeners. Charges apply only to artists, labels, rights-holders or authorised submitters who choose to pay for a one-time chart-entry and promotion service for Tracklist.lol's own charts. No payment is required to use the listener service.
The paid service is fully rendered at the exact moment the track first appears on a Tracklist.lol chart. Charts are limited to the top 100 entries in each published chart. Rank, visibility and duration can change as other artists add points, listeners add likes, points fade, moderation takes place or a chart is refreshed. Any opening rank or fade duration shown before checkout is an estimate, not a promise of a particular position, period or outcome.
Rankpoints are for placement on Tracklist.lol itself. They do not guarantee streams, plays, playlist placement, editorial support or a particular number of listeners.
Rankpoints, likes and the fair-market fade
The price, currency and number of rankpoints for an order are shown before payment. Paid rankpoints fade continuously: a larger opening balance retains more points overall, but its additional opening advantage fades faster during the first days before settling into the ordinary campaign fade. As a campaign gets older, its remaining paid points fade more quickly at seven-day boundaries so newer releases can move through the charts. Fan-earned points are held separately and follow a slower standard freshness fade without the paid-size adjustment. The fade duration displayed in the submit flow is an estimate and may change with chart activity and service events.
Other artists may purchase or receive rankpoints at any time. They may outbid your track, moving it down the chart or off the top 100 without creating a refund or proration right. A listener like adds one rankpoint, subject to our anti-abuse controls. Likes are not cash, cannot be redeemed and do not create a contractual promise of a particular rank.
We may reject, reverse or limit activity that appears automated, manipulated or abusive.
Submitting music and artwork
You must own or control, or have permission to use, the music, artwork, metadata and links you submit. You are responsible for obtaining any permissions needed for Tracklist.lol to store, analyse, display and make the submitted release available through the service.
Keep titles, artist names, categories, links and contact information accurate. You must not submit material that is unlawful, infringing, deceptive, hateful, abusive, malicious or likely to mislead listeners about who made or released it.
Fair use and listener safety
You must not use bots, click farms, scripts, incentivised traffic, fabricated accounts or other artificial activity to generate likes, previews or streaming-service clicks. You must not bypass listener checks, probe protected endpoints, scrape the service at scale, interfere with chart delivery or attempt to manipulate chart results.
We may use rate limits, automated checks, Cloudflare Turnstile and manual review to protect artists, listeners and streaming partners. We may delay, reject or remove activity where there is a reasonable safety, rights, payment or integrity concern.
Independent streaming services
Links opened from Tracklist.lol lead to third-party services such as Apple Music, Spotify, YouTube Music, Deezer, TIDAL or other supported providers. Those services control their own catalogues, apps, accounts, availability, terms and privacy practices.
We do not promise that a provider link will open in a particular app, remain available, play in every territory or result in a stream. Tracklist.lol does not sell or arrange playlist placement on those services.
Orders, payment and refunds
Checkout shows the amount and currency before you pay. Stripe processes payment details on our behalf; Tracklist.lol does not ask you to send card details by email. We may refuse or pause an order where payment, rights, safety or review checks require it.
All transactions are final, except for the narrow confirmed technical-error remedy described in our refund policy and any consumer rights that cannot legally be excluded. You pay for chart entry, not a guaranteed rank, duration, traffic or streaming outcome. The payment flow asks you to request immediate performance and acknowledge the effect on any applicable cancellation or withdrawal right.
The amount and currency shown at checkout are the amount we ask Stripe to collect. Bearsoft Group Ltd is not currently VAT registered. If VAT registration or another tax obligation applies, we will update checkout to show tax-inclusive prices and apply any required cross-border treatment using the billing address or location. While we are not VAT registered, the Tracklist document is a payment receipt and not a VAT tax invoice. A payment confirmation or receipt may be provided by Stripe and/or Tracklist.lol.
Before an order is submitted, checkout asks the submitting artist to tick an unticked checkbox stating: “I agree to the Terms of Service and Refund Policy, and request immediate performance of this digital service. I understand this waives my 14-day right to cancel. I acknowledge that chart rankings fluctuate based on bidding competition and point fading, and accept that all sales are final with no partial refunds.” Mandatory rights always take priority over this acknowledgement.
Your content and our licence
You keep ownership of the music, artwork and other material you submit. You grant Tracklist.lol a non-exclusive, worldwide, royalty-free licence to host, cache, resize, analyse, display and make that material available as needed to operate, secure and explain the service, including through our image and audio delivery routes.
You also permit us to use submitted preview audio, your selected genre and sub-genre, and derived audio-analysis data to train, validate, evaluate and improve internal or future music-classification models. This permission does not transfer ownership of the release or give us permission to sell your contact or payment information. We will not use your submission to imply endorsement or guaranteed success.
That licence lasts for as long as the material is needed for the listing, support, security, model-development records, legal records or backups. We will explain any material change to this use in the privacy notice and seek any additional choice or permission required by law.
Changes, suspension and availability
We may change, pause or discontinue parts of the service, chart definitions, supported providers or pricing. We may suspend or remove a listing or account record where necessary to protect the service, comply with law, resolve a payment or rights issue, or enforce these terms.
We aim to provide a reliable service, but internet services, providers, payment networks and cached chart data can fail or be unavailable. We do not promise uninterrupted access or that any listing will remain visible for a particular period. If a listing is removed after it has appeared because of moderation, rights, fraud, safety or integrity concerns, that does not undo the completed chart-entry service or create a discretionary refund, subject to applicable law.
Legal limits and contact
Nothing in these terms limits rights or remedies that cannot legally be excluded, including applicable consumer rights and remedies for a service that was not supplied or was not performed to the standard required by law. To the extent permitted by law, Tracklist.lol is not responsible for third-party streaming services, user activity, internet failures or indirect loss caused by reliance on an estimated rank or duration.
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction, subject to any mandatory rights that apply to you in your place of residence. We will post material changes on this page and update the date above. Contact mark@bearsoft.com with an order reference and a short explanation; do not send payment-card details. We aim to respond to support and refund queries within 7–10 working days.
